Our partners Mihai Ionescu-Balea and Tasiana Timofticiuc attended INNOCONSTRUCT 2026 last week, the premier event for Romania’s construction market, impeccably organised by TEC Cluster. This year’s edition brought together over 400 participants from the construction industry and focused on strategic debates and discussions about innovation and efficiency in construction.
Mihai Ionescu-Balea delivered a presentation on the advantages of arbitration in construction as a means of dispute resolution:
Specialisation
Arbitration offers a specialised framework for dispute resolution, tailored to the specific needs of the sector. In construction, this translates to the specialisation of the arbitrators adjudicating the dispute, the technical experts providing technical guidance on contentious issues, and the attorneys, who combine legal arguments with technical rigour.
Time
Disputes resolved through arbitration are characterised by efficiency and speed. At the same time, the emergency arbitrator procedure allows for urgent measures, such as the imposition of interim measures or the suspension of the enforcement of guarantees, within a very short timeframe of 10 days.
Costs
Construction arbitration has the advantage of yielding an immediately enforceable award in a single instance, so that the costs that would be incurred in a first-instance trial and appeal are more efficiently managed by resorting to arbitration.
